Supporting local authority clients on the establishment and ongoing structuring of Teckal companies
We advise on funding, back office services, subsidy control, commercial contracts, real estate and procurement compliance, and have been working on these structures since establishing some of the earliest in the UK market in 2010.
In particular, the team has a specialism of delivering legal services to local authority owned housing delivery vehicles. We provide legal services as and when required as these entities work through their delivery plans, regularly advising clients such as Brick by Brick, Homes for Lambeth, Exeter City Living and Populo Living.
The nature of these entities means that funds and contracts need to be moved between the local authority and the corporate group, as well as inside the corporate groups. This requires niche advice on corporate law, governance, subsidy control, procurement and funding. The team has a strong reputation in the market for specialist experience in this field.
Once developments are being planned we support the in house development teams to secure successful delivery. This often includes the provision of full support on construction contracts, construction disputes, property litigation and planning.
Often working with the local authority shareholder, we assist with the land ownership for the sites, using various mechanisms.
Once delivery has been completed we assist with sales of the estate, as well as the conveyancing for plot sales for the delivered units. Where a Registered Provider is required to hold the units, we have assisted with Homes England registration for those entities, including the structuring the boards and inter-corporate arrangements to ensure independence of the RP.
