Construction Dispute - Riva Properties
Successfully acting for Riva Properties on a high profile case against world leading architects Foster + Partners for failure to design Heathrow Airport's first proposed five-star hotel within budget. Obtaining judgment in the High Court against Fosters for £3.6m following a two week High Court trial. The case has attracted a great deal of coverage in the national press and is of significant importance in highlighting Architect's duties in relation to budget when designing.
Construction Dispute - South Coast Construction Limited
Acting for South Coast Construction Limited in an adjudication against Iverson Road Limited (A Reichmann Properties PLC company). The dispute arose out of a residential and commercial project in Central London. We succeeded in obtaining an Adjudicator's decision for approximately £900,000 in favour of South Coast Construction.
Renewable Energy Disposal
Acting for the SPV on the sale and refinancing of an Anaerobic Digestion plant. The plants existing lender wished to divest itself of the plant with the development of a suite of contracts and planning permission for a further development of the plant. Ashfords acted on a competitive membership transfer process including two bidders, in addition to the development of the plant extension, including appointment of an EPC Contractor, civil works contracts, feedstock and operating contracts in addition to professional and technical appointments.
Acting for a national waste operator as a retained advisor for in a complex multi-party dispute arising out of a large municipal waste PFI. A multi-disciplinary team advised the client on the potential termination of the project and a negotiated settlement allowing the Authority to re-procure elements of the project, whilst advising on the operator's claims against/made by the various tiers of subcontractors. The matter included adjudication and court proceedings.
Advising a local authority in setting up their framework agreement for the delivery of capital works, housing and mechanical and electrical works. The work involved drafting the framework agreement for the appointment of contractors and consultants, forms of underlying call off contracts and associated documentation (including collateral warranties, parent company guarantees and performance bonds) together with a form of access agreement to allow other public sector bodies to call off works and services from the framework.
