Building Safety Act 2022 – Construction Projects and Dispute Resolution

The Building Safety Act 2022 (BSA) introduced far-reaching reforms in relation to building safety.  The legislation introduces extended liabilities and impacts the design and construction process in particular for buildings with residential occupants.

We can advise on:

New build projects, refurbishment, alterations and/or remediation work to existing buildings:

  • Dutyholder obligations during the design and construction phase
  • Construction contract drafting and negotiating
  • Considerations around third party funding, for example the expectations and requirements associated with funding through the Cladding Safety Scheme or the Building Safety Fund

Construction disputes connected with the BSA:

  • Defective Premises Act 1972 claims (as amended by the BSA)
  • Building Liability Orders (both residential and commercial buildings)
  • Remediation Contribution Order applications
  • Professional negligence claims
  • Strategic advice on bringing or defending BSA-related claims

In addition, we have a specialist property disputes team which advises on building safety disputes as between landlords and tenants, as well as on property management generally, including landlords certificates and service charge recovery.

Learn more about the Building Safety Act 2022

The Building Safety Act 2022 represents a significant overhaul of the legal framework governing the design, construction, and management of all buildings, but particularly ‘higher-risk buildings’, being buildings at least 18m or 7 storeys high which house 2 or more residential units. It imposes new and separate duties on those involved in the development, design, construction and management of buildings, introduces extended limitation periods, and opens up new routes for claims.
