Similarly we have a wealth of experience acting for housebuilders and developers, meaning that we can head off issues that might otherwise crop up on a disposal to a developer – for example by ensuring any limitations around access are mitigated or that any defects in title are adequately remedied well ahead of any disposal being made. 

Our Real Estate development lawyers are supported by specialist colleagues in a wide range of disciplines who can be called upon as needed. In particular our Planning & Infrastructure Consenting colleagues support our promoter clients as they seek and obtain consents for schemes. We regularly advise promoter clients on s106 planning obligations, and where there is disagreement on planning matters between our promoter clients and the local planning authority and/or other key stakeholders our team works closely with the consultant team to find solutions.

Where planning applications go to appeal our team is experienced in drafting s106 planning obligations under strict timescales imposed by the Planning Inspectorate, and also running those appeals for our clients. Our team regularly attend committees and hearings to advocate on planning matters including town and village green applications and public rights of way.
