General counsel and those working as part of in-house legal teams should prepare now for the new Fixed Recoverable Costs regime which will apply to the vast majority of claims issued on or after 1 October 2023, where the value in dispute is between £10,000 and £100,000.

Almost all claims issued at court on or after 1 October 2023 for disputes of up to £100,000 will be subject to new procedural rules. The successful party’s entitlement to recover its legal costs from the losing party will be limited to the fees prescribed in the new rules.
