Biography

Oscar is an associate in the disputed wills and trusts team.

Oscar specialises in complex contentious trust, succession and estate matters (often with an international flavour). He advises trustees, international trust companies and high-net-worth individuals on all aspects of contentious wills, trusts and estates and has experience litigating in England, Jersey, Guernsey, Hong Kong and the Caribbean jurisdictions.
 
Oscar frequently advises on applications to court in respect of trust interpretation and administration, blessings, contentious partitions of trusts, applications for disclosure of information from trustees, executor/beneficiary disputes, breach of trust claims and professional negligence. He has also acted (successfully) in some of the leading offshore cases concerning applications to set aside transactions on the grounds of mistake or Hastings-Bass, including, exceptionally, in connection with an offshore foundation. 
 
Oscar joined Ashfords in 2024, having previously practised at an international firm in London, where he specialised in high-value, international trust and private client disputes and was recognised as a "key lawyer" in the Legal 500. He has extensive experience of litigating in offshore courts and regularly speaks at international conferences. He also writes for the Ashfords Wealth Brief on topical issues in the private wealth sector. 

Relevant experience

  • Private client: Advising the founder of a Jersey foundation on a (successful) mistake application to Court to set aside historic endowments to the foundation causing substantial unintended tax liabilities (Representation of B and C re the N Foundation and the M Trust [2023] JRC 166). This was a landmark case which was only the second instance of the Court setting aside endowments to a Jersey foundation. 
  • International Trust Company: Advising a trustee in an application to the Court in Jersey to set aside a transaction for unintended tax and legal consequences (The Representation of B Corporation 2022/155 - Mistake Application).
  • Various clients: Representing trustees and beneficiaries on applications for the removal of non-performing trustees and claims for breach of trust.
  • Corporate trustee: Advising a corporate trustee in the private banking sector on a complex blessing application.
  • Corporate trustee: Advising a corporate trustee in the financial services sector on an application to Court for directions regarding the validity of historic transactions affecting the trust.
  • Private client: Advising a family trustee in connection with claims brought against him for misuse of fiduciary powers.
