Biography

David is a partner in our Technology and Data team, specialising in commercial technology transactions, digital business and services, data protection and governance issues, cybersecurity and the development, implementation and exploitation of new technologies, notably AI.

With more than 15 years of experience, David has worked with some of world's largest and most successful technology companies. He also advises clients in the energy and utilities, data centre, retail, financial services, manufacturing and digital creative sectors, and has a strong interest in working with emerging high growth technology businesses.

He advises on complex and business-critical digital transformation projects, technology contracts, the creation and commercial exploitation of intellectual property, data and digital content, software development and licensing, cloud and other IT services agreements, online safety issues, data protection, e-privacy, IoT, connected devices, digital marketing and advertising, GDPR compliance and cybersecurity issues, including advising in relation to live cybersecurity incidents.

He also has extensive experience working on the commercial, technology, data and intellectual property aspects of corporate transactions, with a particular focus on businesses in the technology sector.

David has been recognised by both Chambers and Legal 500 in the areas of IT law and data protection. David co-authored the inaugural Chambers and Partners guide to Artificial Intelligence law, practice and development in the UK.

Prior to joining Ashfords, David was a partner at Burges Salmon. David has previously worked at US firm Morrison & Foerster and trained at Allen & Overy. He is a member of the Society of Computers and Law and the International Technology Law Association.

Relevant experience

  • Advising a regulated financial services business on a live cybersecurity incident, including liaising with the ICO and FCA, assessing liability and merits of a claim against an IT services provider, instructing and liaising with an IT forensic services provider on the client's behalf, dealing with insurers and PR agencies, addressing complaints and queries from affected data subjects and assessing contractual obligations in respect of regulated customers.
  • Advising a leading global provider of cloud services on various technology and data related issues, including enterprise customer agreements with clients across various sectors, including telecoms, financial services, media, automotive and retail, as well as consumer and data protection issues around the launch of a new consumer-facing platform and service.
  • Advising a multi-national consumer-facing online food delivery platform on various technology, data and cybersecurity issues, including IT and SaaS licensing, a business-wide digital transformation program, consumer marketing and e-privacy issues, GDPR compliance and cybersecurity advice, including in relation to several live, urgent and business-critical incidents.
  • Advising a regulated utility on a £360 million cross-market technology services framework agreement covering the provision of a number of technology services relating to hardware, AI, innovation, software development and cybersecurity.
  • Advising Anthology Inc, a leading US-based EdTech provider of PaaS and SaaS services to an international customer base on enterprise agreements with clients, GDPR and data law compliance, and on specific data protection issues.
