JCT Minor Works 2016 - Key Changes

The JCT 2016 Edition has officially launched with the release of the Minor Works family of contracts on 15 June 2016.

Key changes include:

  • The addition of various public sector provisions. For instance, the contract now includes sections relating to the Freedom of Information Act 2000 and fully incorporates the requirements of the Public Contracts Regulations 2015.
  • Amendments to reflect the Construction (Design & Management) Regulations 2015.
  • Increased flexibility surrounding the provisions dealing with insurance of the Works and existing structures. In particular, the parties can now specify in the Contract Particulars that the existing structures shall be insured by "other means". This can accommodate a scenario where, for example, the Employer is a tenant of the existing structures and insurance is maintained by the landlord.
  • Simplification of the payment provisions, including the establishment of "Interim Valuation Dates", revised fluctuations provisions and consolidation of the notice requirements of the Housing Grants, Construction & Regeneration Act 1996.

Look out for the new 2016 editions of the other JCT contracts, which are due for release later this year.
