MIN 641 (M) Navigation: Port Marine Safety Code compliance submission for 2021-2024

On 13th October, the MCA published MIN 641 (M) which gives notice to all Harbour Masters, UK Ports, Harbour Authorities, Marinas and representatives of other marine facilities that they are required to send a signed statement to the MCA confirming their organisation’s Port Marine Safety Code (PMSC) compliance on or before the 31st March 2021.

The PMSC is applicable to both statutory harbour authorities and to other marine facilities which may not have statutory powers and duties. The Code is endorsed by the UK Government, devolved administrations and representatives from across the maritime sector and while the Code is not mandatory, these bodies have a strong expectation that all harbour authorities will comply.  As set out at paragraph 19 of the PMSC, failure to comply can lead to prosecution under the Health and Safety at Work Act 1974.
