Biography
Harriett is an associate in the property litigation team with over 3 years of specialist property disputes experience and over 3 years' previous experience in Ashfords' real estate department.
Harriett works with a range of clients including commercial landlord and tenants; private clients; ports and harbours and Local Authorities.
Harriett’s work is incredibly varied and includes:
- Advising on a variety of commercial landlord and tenant matters including the preparation and serving of Landlord and Tenant Act 1954 notices, preparing and serving court proceedings, advising on break notices and general lease advisory work.
- Residential work including the preparation and service of section 8 and section 21 notices; preparing and serving section 42 lease extension notices; advising on residential leases; advising on Rent Act tenancies and preparing and serving possession proceedings.
- Real property disputes including boundary disputes, advising on right of way issues, rights of access and advising on and preparing Land Registry applications.
- Property related professional negligence disputes.
- Housing disrepair work including advising on liability, quantum and dealing with court proceedings including applying for and obtaining injunctions.
- Claims involving trusts of land including Trusts of Land and Appointment of Trustees Act 1996 (TOLATA) and proprietary estoppel claims.
- Ports and Harbours, including the preparation of licences and advising on commercial lease rights and strategy.
- Harriett also had experience attending mediation in relation to various property matters and attending both County Court and High Court hearings.
- Harriett has also assisted in delivering various internal and external know-how training sessions.
Harriett started work at Ashfords in the real estate department in May 2018 as a paralegal before starting her training contract in February 2021. Harriett undertook seats in the real estate, commercial litigation and commercial departments before qualifying into the property disputes team in September 2022.
Prior to joining Ashfords, Harriett studied law at Cardiff University.
Relevant experience
- Advising a commercial tenant whose lease had been forfeited. Harriett negotiated a commercial settlement which involved a variation to the lease, avoiding significant litigation time and cost and ultimately achieving reinstatement of Ashfords’ client’s lease.
- Advising a private trustee client in relation to Land Registry restrictions involving multiple high-value properties. The dispute was referred to the First-Tier Tribunal and Harriett assisted in negotiating and documenting a complex commercial settlement.
- Advising on and assisting with a complex professional negligence dispute with a history spanning several years and attending a successful mediation.
