Biography
Jessica is an Associate in the Property Disputes team.
Jessica is experienced in dealing with a wide range of contentious landlord and tenant matters with a focus on agricultural, residential and commercial tenancy matters. She is also experienced in advising on a range of real property matters such advising on covenants, easements, boundaries and adverse possession.
Jessica regularly deals with the preparation and service of notices and Court proceedings and has experience of the County Courts and First-tier Tribunal.
Jessica’s clients include local authorities, registered providers, charities, private companies, developers, local landed estates and private individuals.
Relevant experience
Agricultural
- Private individual: Advising on the termination of a tenancy governed by the Agricultural Holdings Act 1986, preparing and serving a Case G notice to quit and advising on succession rights.
- Private individual: Advising on succession rights arising under an Agricultural Holdings Act tenancy and preparing, filing and serving a succession application to the First-tier Tribunal on the death of the tenant in accordance with the strict provisions of the Agricultural Holdings Act 1986.
- Local landed estate: Advising on whether a lease of land qualifies as a farm business tenancy under the Agricultural Tenancies Act 1995.
- Executors/Trustees: Advising on the occupational status of a tenant and whether such occupation and use of the land gives rise to a commercial tenancy under the Landlord and Tenant Act 1954 or an agricultural tenancy under the Agricultural Tenancies Act 1995.
Residential
- Public body: Advising on the termination of assured shorthold tenancies to obtain vacant possession to implement a major flood mitigation scheme.
- Private individual: Advising on a complex contested section 21 possession matter concerning technical issues surrounding protection of the tenancy deposit and defending a counterclaim for disrepair.
- Local authority: Advising on injunction proceedings to address breaches of the tenancy and health and safety concerns.
- Housing association: Assisting with defending claims for housing disrepair and statutory nuisance under the Environmental Protection Act 1990.
Commercial
- Local authority: Advising on defending a forfeiture claim on the basis of dilapidations and rent review.
- Private company: Advising on the grant of a new business tenancy under s.25 of part II of the Landlord and Tenant Act 1954.
- Private company: Advising on landlord’s ability to rely on section 30(1)(f) of the Landlord and Tenant Act 1954 and tenant’s application for the grant of a new tenancy.
