Biography
Associate Amy Penn (6 years’ PQE) advises employers and employees on a wide range of contentious and non-contentious employment law issues but specialises in Employment Tribunal litigation, routinely assisting clients in pursuing and defending claims.
Amy has a broad and varied case load, and has experience in advising clients on a wide range of claims including Unfair Dismissal, Discrimination, Whistleblowing, Equal Pay, and contractual disputes including Unlawful Deductions from Wages. Amy has supported clients, and has a particular interest, in dealing with claims of discrimination and harassment, which require a careful and considered approach due to the often very sensitive nature of the allegations, and potential vulnerabilities of those involved.
Amy also advises on non-contentious employment law issues. In particular, she regularly assists clients in the hospitality sector and in particular for franchisees of a large fast-food retailer providing advice regarding the management of internal processes related to its workforce. Amy also supports a client in the charity and housing sector in providing ad hoc support on HR Processes and practices.
Amy frequently negotiates settlement for clients both as a means of avoiding litigation, and during the process of litigation.

Representing the Respondent, an adult health and social care business, in an Employment Tribunal claim for Unfair Dismissal, and Discrimination and Harassment on the grounds of race. Outcome achieved: the Claimant agreed to withdraw their claims, with no order as to costs.

Representing Claimants in group litigation relating to claims of Unfair Dismissal, Trade Union Detriment, Part-Time Working Regulations, Notice Pay and discrimination following redundancies which arose during the COVID-19 pandemic.
