Amendments to the Insolvency Act 1986 from 6 April 2017

As well as the new Insolvency Rules coming into force on 6 April, there are over 100 amendments to the Insolvency Act that will come into force as well. These amendments are provisions from the Small Business, Enterprise and Employment Act 2015 ("SBEEA") and the Deregulation Act 2015 ("DA"), and are designed to facilitate and run alongside the new Rules.

We have completed an index table of the amendments which you can find here, for use in conjunction with the new Rules. This should direct you to either the SBEEA (mainly Schedule 9) or the DA, where you will find the detail of the amendment to the relevant section.

These amendments remove some obsolete sections (including s98) and add in some new provisions such as alternative decision making procedures (s246ZA, s379ZA). To see how these amendments work together with the Rules, please see our series on the new Rules, starting with Placing a Company into CVL.
