Extending rights for Claimants

The Motor Insurers Bureau ("MIB") has introduced a new Uninsured Drivers' Agreement 2015.

This new Agreement extends some rights as it has removed the current exclusions for Claimants who have knowingly allowed themselves to be carried in vehicles used in furtherance of a crime and to avoid lawful apprehension.

However, the MIB will still be able to reject claims where ex turpi causa applies. (Where the Claimant's illegality bars their entitlement to compensation on policy grounds).

In addition victims of Uninsured Motorists are expected to utilise their own insurance when available or they will not be able to recover via the MIB. This will have a profound impact on credit repair claims which circumvent a claim on a driver's own insurance.
