The right to bring a private prosecution is a valuable safeguard against an arbitrary refusal to bring criminal charges. But magistrates and district judges have a commensurate responsibility. They must not unleash the criminal law without first deciding whether the elements of an offence have been established. And, as I would expect the High Court to say in its forthcoming judgement, those elements were not established here.
