On Thursday 24th April, The Party Wall Disputes Seminar took place at Ashfords' London Office, attracting over 30 external guests from various backgrounds in commercial management, building and valuation surveyors.
The event, which was led by Paul Dunbar, spoke on the recent Kelliher Case where a Judge over turned an award made by a third surveyor and found that removal of plaster from a party wall could be a notifiable act. Paul Dunbar's presentation can be found here.
Our guest speaker, Tom Weekes of Landmark Chambers, spoke on procedural issues and the Party Wall etc Act 1996. Tom argued that imposing a strict deadline for appealing a party wall award was open to challenge under Article 6.1 of the European Convention on Human Rights Act.
