John Bosworth and Gareth Pinwell attended the South West RTPI seminar recently held at Taunton Cricket Ground. John and Gareth presented to 90+ delegates, consisting largely of local authority planning officers, on a range of topics relating to Development Control.
Gareth provided an update on Planning Law, covering the Statutory Test for Determining Planning Applications, National Planning Policy Framework, 106 Obligations and Local Finance Considerations. Gareth discussed a number of prominent cases within the presentation, including the "mushroom case" R (on the application of Thakeham Village Action Ltd) v Horsham District Council and others - 2014 – EWHC 67 Admin and Edinburgh City Council v Secretary of State for Scotland (1997 – 1 WLR 1447). John gave a talk on recent changes to permitted development rights and the further changes that have been announced, which include allowing farmers to convert up to three agricultural building to dwellings, without the need for planning permission. John's presentation can be found here.
Other speakers at the event included Gavin Collett of Magdalen Chambers and Peter Ford, Manager of the Development Control team at Plymouth City Council.
Following the morning session, the seminar broke into three groups. John and Gareth led three discussion groups, re-visiting topical issues in development control that arose from the morning sessions.
