Legacy Management

Ashfords' Legacies Team specialises in assisting national and regional charities with legacy administration as well as advising on all matters arising out of contentious wills, trusts and estates. We adopt a commercial and pragmatic approach and have extensive experience of resolving disputes by mediation and other forms of Alternative Dispute Resolution.

We understand that charities rely on legacies for a very significant proportion of their income and as a result, it is important that they are able to protect their bequests and maximise the income intended for them by the deceased. We also know that charities need to ensure that their operations are as streamlined as possible and that the maximum amount received from legacies goes into the front-line services for which they were intended. We assist a number of charities by using our skills to complement their in-house teams or alternatively we can deal with estate administration on an outsourced basis.

How we can help

We are able to advise on broad range of matters including:

  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975 for financial provision from an estate
  • Applications concerning the interpretation and constructions of wills
  • Professional negligence claims (arising out of advice regarding trusts, wills and estates)
  • Executor/trustee disputes
  • Debt recovery and enforcement actions against a deceased’s estate
  • Cy-près applications
