Shipping and Transport
Ashfords' Marine Team has experience in all aspects of commercial shipping, transport and aviation sectors and has specialist knowledge of the fishing industry, acting primarily for fishing boat owners and crew on regulatory matters and licensing. We also undertake work on behalf of a number of harbour authorities, advising on the complexities of Harbour Revision or Empowerment Orders - including advising on the re-drafting of byelaws. The team deals with both contentious and non-contentious matters and acts for clients both nationally and worldwide. Its client base include P&I Clubs, Underwriters, fishing co-operatives and individual owners, ships crews (primarily in personal injury matters), aircraft and helicopter charter companies, ship owners and charterers. The team also acts for individuals and companies purchasing/selling commercial vessels, and large corporate companies involved in the commercial shipping and aviation sectors .
We hold memberships of the British Marine Federation and British Maritime Law Association and work frequently through our international network of correspondents - known as Advoc - in over 40 jurisdictions.
Work handled includes:
Non-contentious matters
- Shipbuilding, ship conversion and repair contracts (for wide ranging types of vessels over 20 metres);
- Ship finance documentation, including loan agreements, deeds of covenants and related documentation;
- Drafting reports commissioned by government agencies, local authorities and/or district councils (most recently in respect of the "Napoli" incident);
- Charter party agreements - time, voyage or bareboat;
- Crew management agreements;
- Fishing Industry licence agreements and quota entitlements;
- Advice to Harbour Authorities on Revision Orders and Empowerment Orders;
- Rail sector service agreements and joint venture agreements; and
- Aircraft sale and purchase advice, including security and finance documentation
- Charterparty and Bill of Lading disputes;
- Ship arrest in a wide variety of jurisdictions;
- Collision, salvage and total loss claims;
- Unsafe port and unseaworthiness claims;
- Casualty Investigations;
- Cargo damage and shortage claims;
- Personal Injury/loss of life claims;
- Disputes including those on behalf of ship owners, skippers and fishermen bought by the Marine Fisheries Agency, acting for crew and ship owners to resolve disputes and disputes in the offshore industry (particularly the energy-windfarm sector);
- All aspects of EC transport legislation, particularly in the transport and fishing industries;
- Road transport and through carriage claims including CMR;
- Oil pollution claims including defending shipping companies particularly against assertions by the EA;
- Aircraft/helicopter sale and purchase (and other) disputes;
- Marine professionals' negligence claims (mainly for underwriters); and
- Middle East related shipborne security issues/claims
Recent work undertaken includes:
- Acting for Claimant in respect of the MSC "Napoli" incident;
- Acting for the national Local Government Association (and drafting appropriate report). Also preparing report for the Public Inquiry and acting for claimants arising out of the incident, (e.g. National Trust);
- Advising major PLC on harbour/berth related incidents;
- Acting for a large ship owning company to resolve oil pollution claims;
- Acting for Danish oil company in delivery claim;
- The enforcement of security issues on behalf of international finance companies;
- Acting for aircraft operator/owner in a series of international disputes;
- Advising major helicopter operator on major repair dispute;
- Acting for a major engineering plant exporter on letters of credit and bill of lading issues;
- Drafting and negotiating terms of agreements relating to a series of construction contracts for Tamer class lifeboats;
- Acting for London underwriters on a series of professional negligence claims;
- Advising harbour authorities in respect of ferry related disputes; and
- Acting for Claimants in major personal injury actions.
