Powers of Attorney

A Power of Attorney is a legal document by one person appointing another to handle his or her affairs. Ashfords' experienced solicitors are familiar with all types of Powers of Attorney and regularly act as professional Attorneys under them. Our role often brings us into contact with individuals with diminishing mental capacity in difficult circumstances. Our approach is professional whilst sympathetic and understanding. Choosing the right person to act for you under a Power of Attorney is vital.

Following the introduction of Lasting Powers of Attorney in October 2007, a Power of Attorney can now be created to allow another to not only manage your financial affairs, but also to make decisions about your medical welfare.

Anyone wanting to create a Power of Attorney has a choice between creating a General Power or a Lasting Power of Attorney. All Enduring Powers of Attorney created before October 2007 remain valid. If you hold a Power of Attorney for someone you must not exceed the scope of that authority and keep an accurate record of the actions you take under that Power. The choice, rules and regulations are therefore becoming increasingly complex.
