David is a Partner and Head of the Restructuring and Insolvency Team.
He advises on contentious and non-contentious corporate and personal insolvency. He is most frequently found working alongside Insolvency Practitioners or the management team of a struggling business. He has particular expertise in the legal services, retail, hospitality and agricultural sectors. He has also dealt with a number of deceased insolvent estates.
David also advises on antecedent claims, expertise in fraud investigation and asset tracing.
David is recognised in the Legal 500 as a "Leader in his field" and is described as "very knowledgeable" and "sharp and thorough". Chambers & Partners refer to his "experience in both corporate and personal issues, he offers a tenacious approach to any problem".
He is also a Fellow of the Association of Business Recovery Professionals (R3) and a member of the Insolvency Lawyers Association.
- Hostile application for an Administration Order and then advised the Administrators whilst the businesses was traded for 9 months before being sold as a going concern. Substantial return to creditors who would otherwise have received nothing at all.
- Advised the majority of the Board of a clothing manufacturer. The business had been struggling financially and the Board was deadlocked, each faction accusing the other of serious misconduct. Worked closely with PwC and, after intense negotiations with investors and key suppliers, delivered the solvent restructuring of the business.
- Sale of a high tech aircraft engineering business as a going concern as a result of an accelerated M&A process which preserved the customer list (and thus the value of the IP) which would have been lost in the event of a formal insolvency.
- Freezing Order obtained against a Bankrupt and family members after unravelling a complex series of property transactions. Case settled on substantial payment to the Trustee in Bankruptcy.
