Alan is a Partner in Ashfords' Restructuring and Insolvency Department and leads the Debt Recovery Team. He specialises in insolvency matters, both corporate and personal, dealing with insolvency practitioners, secured lenders and unsecured creditors, directors, debtors and their families. He also leads and supervises the firm's dedicated debt recovery team which provides a full range of debt recovery services on behalf of corporate, private, but more particularly public sector clients. With a wealth of litigation experience, Alan prides himself on providing commercial awareness to meet the client's objectives.
As the key relationship partner with other public sector clients, Alan is aware of that sector's often competing obligations to deliver cost-effective services to its stakeholders. With that in mind, and in partnership with other public sector clients, Alan has been working to deliver debt recovery solutions that provide a high level of successful recovery with minimum cost. Conscious of the need for all clients within the public sector to maximise efficient delivery of services, Alan will tailor successful solutions for one client, to the needs of others.
Recent experience includes:
- collection of unpaid Council Tax for Torbay Council and Mid Devon County Council, enforcing liability orders by way of appropriate enforcement methods including charging orders, third party debt orders and insolvency proceedings;
- enforcement of a high value interim costs award made in favour of a public authority against the unsuccessful party in a High Court matter;
- insolvency advice and proceedings on behalf of a major London Borough, enforcing judgments and recovering unpaid rent;
- recovery of high value loan agreements on behalf of a Regional Development Agency by way of insolvency proceedings;
- recovery of breaches of letting management agreements for Hamptons Plc;
- acting for one of the UK's largest consumer credit administration services, to recover money due and owing under defaulted consumer credit agreements; and
- successful recovery of a six figure sum for a client in a one day trial in the Royal Courts of Justice resulting in a payment in full for the client on a costs neutral basis.
