Motor Insurance Regulation Bill 2010-11
Thursday 22nd September 2011Labour MP Jack Straw has introduced the Motor Insurance Regulation Bill 2010-11 to the House of Commons following the Government's decision to ban referral fees in personal injury claims.
The bill proposes to:
- Make it a criminal offence to solicit, offer, or pay referral fees in relation to any personal injury claim made resulting from a road traffic accident;
- Require objective evidence for whiplash claims and restrict whiplash claims to cases where there is genuine evidence of injury;
- Halve the claimant solicitors' costs for cases in the electronic RTA portal;
- Prevent insurers isolating risk based on postcodes, making it unlawful to use any geographic area smaller than a region for risk calculation;
- Use provisions in the Data Protection Act to prevent the "selling on" of accident victim details; and
- Introduce proceedings in the new Bribery Act 2010 to be implemented against the worst offenders.
The second reading date for the bill is 20 January 2012.
