Monday 5th November 2012The recent case of Ampurius Nu Homes Holdings v Telford Homes (Creekside) Ltd [2012] draws into focus the interpretation of the frequently used contractual phrases, "due diligence" and "reasonable endeavours to procure" in relation to the deliberate cessation of construction work due to funding difficulties. In the challenging economic climate there are few within the Construction Industry who would object to the statement that projects often run into funding problems.
