Debt Recovery
Ashfords' Debt Recovery Team acts for a variety of organisations on all types of debt recovery matters, including independent schools, local authorities, property agents, wholesalers and further education colleges. We have experience of recovering all forms of commercial and consumer debts including fees, unpaid invoices for goods or services, late payment penalties pursuant to the Late Payment legislation, and statutory debts.
We work in partnership with clients, the primary aim being to recover as much debt as possible without resorting to formal legal proceedings. Where proceedings are necessary, they are conducted on a fixed costs structure tailored to the client’s specific needs.
In relation to fee-charging education providers, our experience includes advising in relation to unpaid fees and fees in lieu of notice, for example where payment requests result in complaints such as bullying or educational negligence. We recognise the potential tension between factors such as commercial cost, management time, and setting precedents, and the need to find the right balance between these to best meet your needs.
