Divorce and Separation
When a relationship breaks down it is difficult to envisage how it will affect you (and your children), especially if you are unsure of your rights. Ashfords' Family Law Team undertake a significant amount of work in the area including the resolution of financial issues and have the experience to assist you in coming to terms with separation or divorce, as well as any issues over children and finances.
We have particular expertise in cases involving businesses, from the self employed and owner-managed businesses to plcs and senior directors, trusts, farms, pensions, properties, debt and insolvency, and will endeavour to find the solution that works for you and your family.
When a separation is inevitable you do not necessarily need to divorce immediately, but you should carefully consider your options. Financial and family arrangements can be agreed and evidenced by a formal Deed of Separation. Where an agreement cannot be reached we can assist you in applying to the Court for a Decree of Judicial Separation, which does not dissolve the marriage but is rather merely an order of court that dissolves the obligations or benefits brought on by a marriage.
Divorce
In order to obtain a divorce you need to have been married for a minimum of 12 months, and will also need to show that your marriage has irretrievably broken down.
We provide assistance and representation in respect of:
- The divorce procedure (the formal legal process by which the marriage is ended);
- Financial arrangements ('ancillary relief'); and
- Childcare arrangements.
