Court of Protection

Where an individual has become mentally incapable of handling their own property and affairs, unless they have provided for such a situation by executing an Enduring or Lasting Power of Attorney, it is necessary to apply to the Court of Protection for a Receiver to be appointed to look after their day to day financial affairs. Ashfords' senior lawyers are experienced in acting as Professional Receivers for a wide range of individuals, as well as assisting families with the complex application forms.

Generally if the patient's estate does not exceed £10,000.00, an appointment is not necessary.

If their estate is over that amount, an application will be necessary.

The Receiver should provide details of the patient's property and affairs, details of his own personal experience and medical evidence. Certain relatives will be advised as well as the patient.

Once an Order has been made, the Receiver has a duty to act in accordance with that Order and deal with the day to day administration of that patient's affairs. The Receiver will be responsible for producing annual accounts.
