Mediation and Alternative Dispute Resolution
Introduction
Ashfords have mediated in various types of dispute and advising clients bringing claims to mediation of the process and tactics.
We have three qualified mediators who are partners in Ashfords, David Beadel, Ian Daniells and Stephen Homer. All three have significant levels of experience as mediators and are all ADR Group accredited.
Ian Daniells is a director of ADR Group, one of the biggest providers of training and panels for mediators in the Country
Work handled includes:
- Acting as the chosen mediator in disputes in many different areas including Professional Negligence, Company and Partnership Disputes, Contractual Disputes, Insurance Claims, Inheritance Act claims, Defamation and Reputation Management, Pension claims, Shareholder and Fiduciary Duty claims, Insolvency and Construction.
- Advising clients on bringing claims to mediation, process and tactics
- Advising clients on other forms of ADR including Early Neutral Evaluation and Arbitration.
Recent work undertaken includes:
- Several professional negligence claims including a mediation between Claimant and Defendants and supplemental mediation between Defendants all done in one day
- Contractual dispute between Business and Supplier on terms applicable
- Dispute between builder and homeowner on services provided
- Partnership disputes, including farming and accountants
- Inheritance Act Dispute where all parties family members
- Professional negligence on Personal Injury actions
- Inheritance Act Claim involving a Trust, a business and family members – resolved by a two-stage mediation over two days – had been ongoing over several years.
- Disputes over professional fees
- Numerous Construction disputes (Stephen Homer)
- Defamation and loss of reputation claim (David Beadel)
- Pensions disputes (numerous including Equitable Life claims – Ian Daniells)
- Several property disputes and dispute regarding restrictive covenants affecting land
- Numerous personal injury disputes
