An increasing number of couples live together ('cohabit') rather than get married. Unfortunately, unmarried couples tend to break up as much if not more than married couples. They often have exactly the same problems as married couples who are separating (children, properties, etc) but they do not have access to the divorce court and the procedures and principles that regulate the affairs of married couples who separate. The law in this area is derived from disparate sources. These are in part historically based which can lead to unintended consequences, sometimes helpful and sometimes much less so.
