Restructuring and Insolvency

In the current market, unfortunately schools sometimes find themselves needing to consider restructuring, selling or even closing. We recognise that the issues which arise in such situations may require input in a number of areas of expertise.

At Ashfords we benefit from our cross-departmental approach of working, and draw on expertise from relevant colleagues, for example in our Education, Employment, Corporate/Commercial, Property and Planning teams to advise on issues such as:
  • Restructuring and business/asset sales;
  • Drafting and advising on sale agreements and related loan documentation;
  • Charity law issues such as compliance with section 36 of the Charities Act;
  • Reputation management - communications and timing;
  • Commercial Property/Planning issues;
  • Directors duties/disqualification proceedings;
  • TUPE issues;
  • Administrations, Liquidations and Administrative Receiverships;
  • Company and Individual Voluntary Arrangements;
  • Insolvent Partnerships; and
  • Insolvency litigation.
