Compulsory Purchase

Ashfords has real strength in depth in compulsory purchase and compensation advice, with a team of three senior lawyers with considerable expertise in this specialist area. We act for a variety of public sector bodies with compulsory purchase powers, as well as advising their development partners and landowners who are under threat of compulsory acquisition.

Work handled includes:
  • drafting, making, submission and promotion of compulsory purchase orders (CPOs);
  • land referencing;
  • advice on land compensation issues including ransom status;
  • CPO indemnity agreements;
  • lands Tribunal references;
  • making general vesting declarations;
  • advice on statutory wayleaves;
  • certificates of alternative development; and
  • objecting to compulsory purchase orders.
Recent work undertaken includes:
  • St Austell town centre - acting for the local planning authority in using its planning powers to promote a town centre compulsory purchase order;
  • Wembley Stadium - advising the land owners in connection with a 10 day Lands Tribunal hearing regarding the assessment of compensation for land acquired for the access bridge to the National Stadium;
  • Taunton Flood relief works - agreeing a compensation package for a consortium of landowners over whose land rights were acquired under threat of using compulsory purchase powers;
  • Royal William Yard, Plymouth - a complicated compulsory purchase order promoted to secure an improved access to this flagship development; and
  • Carrick District Council - advice on the promotion of housing CPOs in respect of empty properties, including the confirmation unopposed of a housing CPO.
